Student with 'hearing and speech' challenge wins court case against university for expelling her

A student of the Rivers State University of Science and Technology who was expelled in 2015 for having “speech and hearing challenges", has been reinstated to continue her studies.

Following the expulsion, Jane Ottah, 28, dragged the university management before a Rivers State High Court for expelling her on grounds of her disability. The case has however been settled out of court between the University management and the student.

The expelled student demanded a payment of N20 million as damages from the University along with other benefits such as provision of necessary support facilities to aid her learning process, with a demand for a perpetual injunction restraining the university or their agents from discriminating against her in anyway .

She told Premium Times: “I won the case, I’m going back to school”.

The defendant’s counsel, Rotimi Oguneso who took up the case after it was earlier reported by Premium Times, confirmed that the matter had been settled.

He said: “We filed terms of settlement in court and same was adopted, the court recognized it as a settlement and it’s binding on all parties,” Mr. Oguneso, a Senior Advocate of Nigeria, said over the phone on Wednesday.

“So the university will take her back, she’s resuming in the next academic session," he said.
